These Terms of Service (“Terms”) govern your access to and use of NextGen Studio(the “Service”), an AI-powered animation platform that generates storyboards, character art, voiceovers, and video from text prompts across 2D, 3D, anime, photorealistic, and custom reference styles. The Service is operated by Shaun Jonck, a sole proprietor trading as NextGen Studio, based in South Africa(“we”, “us”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility & account
You must be at least 13 years old to use the Service, and at least 18 to make purchases. If you're using the Service on behalf of an organization, you confirm you have authority to bind that organization to these Terms. You're responsible for keeping your login credentials secure and for all activity under your account.
Account authentication is handled by Clerk. You can read Clerk's privacy policy for details on how authentication data is handled.
2. Credits, billing, and Dodo Payments
The Service runs on a credit-based model. Credits can be purchased one-time as top-up bundles or as part of a recurring monthly subscription. Specific credit costs for each action (script generation, image generation, video render, etc.) are listed on the billing page.
- All payments are processed by Dodo Payments, who acts as our merchant of record. Dodo Payments handles taxes, refunds, chargebacks, and PCI compliance. Your card details are never stored on our servers.
- Subscriptions auto-renew at the end of each billing period until canceled. You can cancel any time from the billing page; access continues through the end of the period you already paid for.
- Credits are deducted up front when you start a generation. If a generation fails due to a server error on our side, the credits are automatically refunded to your balance.
- Free credits granted on signup are promotional and have no cash value.

3. Affiliate program
Any account in good standing can join the affiliate program free of charge. Joining creates a referral code and makes these terms part of your agreement with us. The commission rate shown on your dashboard when you enroll is the rate you keep, even if we change the rate for people who join later.
How a referral is credited
- Attribution is first touch. The first affiliate whose link or code a new user arrives with is credited, and that credit is never reassigned to anyone else.
- The signup must happen within 90 days of the click, on an account created within the last 30 days that has not already paid us. Referrals of existing or already-paying customers do not qualify.
- Commission is a percentage of the payments we actually receive from your referred customers, and continues for as long as they stay subscribed.
- We may run a discount for referred customers (for example, a percentage off their first month). It is applied automatically at checkout for anyone who arrived through an affiliate link, can change or stop at any time, and your commission is calculated on what the customer actually pays.
- Promotional material we provide (scripts, thumbnails, copy) is yours to use for promoting us. You must disclose that your link is an affiliate link, must not describe paid plans as free, and must not make earnings or results claims on our behalf.
- If you change your referral code, older links keep working. We keep retired codes pointed at your account for this reason.
What disqualifies a referral
- Self-referral. You may not refer yourself, an alternate or household account, or anyone acting on your behalf. This includes signing up a second account to claim your own commission.
- Paid search on our brand. You may not bid on NextGen Studio or close variants as keywords, or run ads that could be mistaken for our own.
- Misrepresentation. You may not claim to be NextGen Studio, speak for us, promise features or discounts we do not offer, or post your link as unsolicited bulk messaging.
- Automated or fake traffic. Bots, click farms, incentivized signups, and accounts created solely to trigger commission do not qualify.
We may withhold or reverse commission on any referral that breaks these rules, and may suspend or remove an account from the program. Where we believe the breach was deliberate, unpaid balance may be forfeited.
Refunds and chargebacks
Commission is calculated from payments actually received and kept. If a referred customer is refunded or charges back, the matching commission reverses automatically. If that happens after we have already paid you, the resulting negative balance carries forward and is offset against your future commission rather than being invoiced back to you.
Payouts and taxes
- Payouts run monthly by PayPal on balances of $20 or more. Anything smaller rolls over to the following month.
- You are responsible for supplying a valid payout address and the tax details we need. We may hold a payout until they are provided or a review is complete.
- You take part as an independent contractor, not an employee, partner, agent, or joint venturer. You are responsible for your own taxes on what you earn.
- Where we are required to report payments (for example, US persons paid $600 or more in a calendar year, who must supply a Form W-9 and will receive a Form 1099-NEC), payouts may be held until that information is on file.
Changing or ending the program
We may change the commission rate for future enrollments, adjust the payout minimum, or end the program entirely. If we end it, we will pay balances earned up to that point at the next scheduled run, subject to the rules above. You can leave at any time by asking us to close your affiliate account; your link stops crediting new signups from that point.
4. Your content (inputs and outputs)
Inputs
“Inputs” are the scripts, prompts, reference images, voice samples, and any other content you submit to the Service. You retain ownership of your Inputs. You grant us a worldwide, non-exclusive license to host, process, and transmit your Inputs solely for the purpose of operating the Service for you.
You represent and warrant that you have the rights to submit each Input, including any rights of publicity, copyright, or trademark of third parties. In particular: do not upload voice samples of people who haven't given you explicit consent to clone their voice, and do not upload reference images you don't own or have a license to.
Outputs
“Outputs” are the storyboards, images, audio, and videos the Service generates from your Inputs. As between you and us, you own your Outputs and may use them commercially, subject to these Terms and applicable law.
AI-generated content can occasionally resemble existing works, copyrighted material, or real people. We don't guarantee that Outputs are free of third-party claims, and we don't guarantee copyright protection for AI Outputs in your jurisdiction. You are solely responsible for reviewing Outputs before publishing or distributing them.
Our license to operate
We may store your Inputs and Outputs to provide and improve the Service (for example, so you can re-open a project later). We do not train foundation models on your private project content. Some operations (e.g. Gemini, ElevenLabs voice generation, AI video generation) are routed to third-party AI providers under their respective privacy policies - see Privacy Policy for details.
5. Acceptable use
You agree not to use the Service to:
- Generate content that sexualizes minors or depicts child sexual abuse.
- Generate non-consensual intimate imagery of any real person.
- Impersonate a real, identifiable person - including their voice or likeness - without that person's explicit consent.
- Generate content that incites violence, harassment, or unlawful discrimination against a person or protected group.
- Create disinformation designed to deceive viewers about real events, real people, or election integrity.
- Infringe anyone's copyright, trademark, publicity rights, or privacy rights.
- Probe, scan, or attack the Service's infrastructure, attempt to bypass safety filters, or use the Service to develop competing AI models.
- Resell raw API access or operate a downstream Service on top of ours.
We may suspend or terminate accounts that violate these rules, with or without notice depending on severity. See the full Acceptable Use Policy for examples.
6. Third-party services
The Service relies on third-party providers including Google (Gemini), ElevenLabs (voice synthesis), AI video providers, Clerk (authentication), Dodo Payments (payments), and cloud infrastructure providers. Their availability, pricing, or terms can change with little notice. If a provider becomes unavailable, the affected feature may be temporarily disabled.
7. Intellectual property
The Service itself - including its UI, code, brand, documentation, and the underlying pipeline - is owned by us and protected by copyright, trademark, and other laws. These Terms do not grant you any rights in our trademarks or trade dress.
8. Termination
You may close your account at any time by contacting businessvisionmediagroup@gmail.com. We may suspend or terminate your account if you breach these Terms, if your account creates risk or legal exposure for us or other users, or if your account remains inactive for an extended period. On termination, your right to use the Service ends; some provisions of these Terms (Sections 3, 8, 9, 10) survive termination.
9. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties - express, implied, statutory, or otherwise - including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not warrant that AI Outputs will be accurate, original, copyrightable, or suitable for any particular purpose.
10. Limitation of liability
To the fullest extent permitted by law, in no event shall Shaun Jonck, trading as NextGen Studio, its affiliates, officers, employees, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service. Our aggregate liability for any claim relating to the Service is capped at the greater of (a) the amounts you paid us in the twelve months before the claim arose, or (b) USD $100.
11. Indemnity
You agree to indemnify and hold harmless Shaun Jonck, trading as NextGen Studiofrom any claim, liability, or expense (including reasonable attorneys' fees) arising out of your Inputs, your Outputs, your use of the Service, or your breach of these Terms.
12. Changes to the Service or Terms
We may modify the Service, including pricing and credit costs, at any time. We may also change these Terms; if we make material changes, we'll post a notice on the Service or email you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing law & disputes
These Terms are governed by the laws of South Africa, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be brought in the courts of South Africa. Nothing in these Terms removes mandatory consumer protection rights you may have under your local law.
