These Terms of Service (“Terms”) govern your access to and use of NextGen Studio(the “Service”), an AI-powered animation platform that generates storyboards, character art, voiceovers, and video from text prompts across 2D, 3D, anime, photorealistic, and custom reference styles. By creating an account or using the Service, you agree to these Terms.
1. Eligibility & account
You must be at least 13 years old to use the Service, and at least 18 to make purchases. If you're using the Service on behalf of an organization, you confirm you have authority to bind that organization to these Terms. You're responsible for keeping your login credentials secure and for all activity under your account.
Account authentication is handled by Clerk. You can read Clerk's privacy policy for details on how authentication data is handled.
2. Credits, billing, and Paddle
The Service runs on a credit-based model. Credits can be purchased one-time as top-up bundles or as part of a recurring monthly subscription. Specific credit costs for each action (script generation, image generation, video render, etc.) are listed on the billing page.
- All payments are processed by Paddle.com Market Ltd, who acts as our merchant of record. Paddle handles taxes, refunds, chargebacks, and PCI compliance. Your card details are never stored on our servers.
- Subscriptions auto-renew at the end of each billing period until canceled. You can cancel any time from the billing page; access continues through the end of the period you already paid for.
- Credits are deducted up front when you start a generation. If a generation fails due to a server error on our side, the credits are automatically refunded to your balance.
- Free credits granted on signup are promotional and have no cash value.

3. Your content (inputs and outputs)
Inputs
“Inputs” are the scripts, prompts, reference images, voice samples, and any other content you submit to the Service. You retain ownership of your Inputs. You grant us a worldwide, non-exclusive license to host, process, and transmit your Inputs solely for the purpose of operating the Service for you.
You represent and warrant that you have the rights to submit each Input, including any rights of publicity, copyright, or trademark of third parties. In particular: do not upload voice samples of people who haven't given you explicit consent to clone their voice, and do not upload reference images you don't own or have a license to.
Outputs
“Outputs” are the storyboards, images, audio, and videos the Service generates from your Inputs. As between you and us, you own your Outputs and may use them commercially, subject to these Terms and applicable law.
AI-generated content can occasionally resemble existing works, copyrighted material, or real people. We don't guarantee that Outputs are free of third-party claims, and we don't guarantee copyright protection for AI Outputs in your jurisdiction. You are solely responsible for reviewing Outputs before publishing or distributing them.
Our license to operate
We may store your Inputs and Outputs to provide and improve the Service (for example, so you can re-open a project later). We do not train foundation models on your private project content. Some operations (e.g. Gemini, ElevenLabs/69labs voice generation) are routed to third-party AI providers under their respective privacy policies - see Privacy Policy for details.
4. Acceptable use
You agree not to use the Service to:
- Generate content that sexualizes minors or depicts child sexual abuse.
- Generate non-consensual intimate imagery of any real person.
- Impersonate a real, identifiable person - including their voice or likeness - without that person's explicit consent.
- Generate content that incites violence, harassment, or unlawful discrimination against a person or protected group.
- Create disinformation designed to deceive viewers about real events, real people, or election integrity.
- Infringe anyone's copyright, trademark, publicity rights, or privacy rights.
- Probe, scan, or attack the Service's infrastructure, attempt to bypass safety filters, or use the Service to develop competing AI models.
- Resell raw API access or operate a downstream Service on top of ours.
We may suspend or terminate accounts that violate these rules, with or without notice depending on severity. See the full Acceptable Use Policy for examples.
5. Third-party services
The Service relies on third-party providers including Google (Gemini), 69labs (Veo3 video, ElevenLabs voices), Clerk (authentication), Paddle (payments), and cloud infrastructure providers. Their availability, pricing, or terms can change with little notice. If a provider becomes unavailable, the affected feature may be temporarily disabled.
6. Intellectual property
The Service itself - including its UI, code, brand, documentation, and the underlying pipeline - is owned by us and protected by copyright, trademark, and other laws. These Terms do not grant you any rights in our trademarks or trade dress.
7. Termination
You may close your account at any time by contacting businessvisionmediagroup@gmail.com. We may suspend or terminate your account if you breach these Terms, if your account creates risk or legal exposure for us or other users, or if your account remains inactive for an extended period. On termination, your right to use the Service ends; some provisions of these Terms (Sections 3, 8, 9, 10) survive termination.
8. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties - express, implied, statutory, or otherwise - including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not warrant that AI Outputs will be accurate, original, copyrightable, or suitable for any particular purpose.
9. Limitation of liability
To the fullest extent permitted by law, in no event shall NextGen Studio, its affiliates, officers, employees, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service. Our aggregate liability for any claim relating to the Service is capped at the greater of (a) the amounts you paid us in the twelve months before the claim arose, or (b) USD $100.
10. Indemnity
You agree to indemnify and hold harmless NextGen Studiofrom any claim, liability, or expense (including reasonable attorneys' fees) arising out of your Inputs, your Outputs, your use of the Service, or your breach of these Terms.
11. Changes to the Service or Terms
We may modify the Service, including pricing and credit costs, at any time. We may also change these Terms; if we make material changes, we'll post a notice on the Service or email you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing law & disputes
These Terms are governed by the laws of the jurisdiction in which NextGen Studio is established, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be brought in the courts of that jurisdiction. Nothing in these Terms removes mandatory consumer protection rights you may have under your local law.
